Please read these Terms of Service (“Terms”) carefully before using the website luminec.ca (the “Site”) operated by Luminec (“Luminec”, “we”, “us”, or “our”). By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.
Luminec is a Canadian skincare brand offering cosmetic products for sale online. Our products are cosmetics intended for external use only and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
By using this Site, you represent and warrant that you are at least the age of majority in your province or territory of residence, or that you are using the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms. You further represent that all information you provide to us is accurate, current, and complete.
3.1 Product Descriptions. We make every reasonable effort to display our products and their ingredients, colours, textures, and packaging as accurately as possible. However, we do not warrant that product descriptions, images, or other content on the Site are entirely accurate, complete, reliable, current, or error-free. Actual products may vary slightly from images shown due to screen settings, lighting, product batch variations, or packaging updates.
3.2 Cosmetic Use Only. All Luminec products are cosmetics as defined under the Food and Drugs Act (Canada) and its regulations. They are intended for external, topical use only. Nothing on this Site constitutes medical advice, and our products are not a substitute for professional medical care.
3.3 Allergies and Sensitivities. Ingredient lists are provided for each product on the Site and on product packaging. It is your responsibility to review ingredient lists before purchase and use. We strongly recommend performing a patch test before first use of any new product. If irritation or an adverse reaction occurs, discontinue use immediately and consult a healthcare professional. If you have sensitive skin, allergies, a skin condition, or are pregnant or nursing, consult a physician or dermatologist before using any new cosmetic product.
3.4 Product Availability. All products are offered subject to availability. We reserve the right to limit quantities, discontinue any product at any time, or restrict sales of any product to any person, geographic region, or jurisdiction, on a case-by-case basis, without notice.
4.1 Order Process. When you place an order through the Site, you are making an offer to purchase the selected products. Our acknowledgment of your order (including an automated order confirmation email) does not constitute acceptance of your offer. A contract of sale is formed only when we ship your order and issue a shipping confirmation.
4.2 Right to Refuse or Cancel. We reserve the right, at our sole discretion, to refuse or cancel any order at any time before shipment, including without limitation orders that: (a) appear to be placed by resellers, dealers, or distributors without authorization; (b) contain pricing, description, or availability errors; (c) are flagged by our fraud-prevention systems; (d) exceed quantity limits; or (e) cannot be shipped to the address provided. If we cancel an order after payment has been processed, we will issue a full refund to the original payment method.
4.3 Order Accuracy. You are responsible for reviewing your order, including products, quantities, shipping address, and contact details, before submitting it. We are not responsible for delays or failed deliveries resulting from inaccurate or incomplete information provided by you.
5.1 Currency. All prices on the Site are listed in Canadian dollars (CAD) unless otherwise stated.
5.2 Taxes. Applicable federal and provincial taxes (GST, HST, PST, or QST, as applicable) will be calculated and added at checkout based on the shipping destination.
5.3 Price Changes. Prices are subject to change at any time without notice. Price changes will not affect orders for which you have already received a shipping confirmation.
5.4 Pricing Errors. Despite our best efforts, occasional pricing, typographical, or availability errors may occur on the Site. We reserve the right to correct any errors and to cancel or refuse any order placed at an incorrect price, whether or not the order has been confirmed and your payment method charged. If your payment has been charged and your order is cancelled due to an error, we will issue a full refund.
5.5 Payment. We accept the payment methods indicated at checkout. By providing a payment method, you represent that you are authorized to use it and you authorize us (and our third-party payment processors) to charge the full order amount, including taxes and shipping fees. We do not store full payment card details; payments are processed by secure third-party payment providers.
5.6 Promotions and Discount Codes. Promotional offers and discount codes are subject to their stated conditions, may not be combined unless expressly permitted, have no cash value, and may be modified or withdrawn at any time. We reserve the right to cancel orders that misuse promotional codes.
6.1 Shipping Areas. We currently ship to addresses within Canada and to such other countries as may be indicated at checkout. Shipping fees and estimated delivery times are displayed at checkout.
6.2 Delivery Estimates. Delivery dates and times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs, weather, or other events outside our reasonable control.
6.3 Risk of Loss and Title. Title to products and risk of loss pass to you upon our delivery of the products to the carrier, except where otherwise required by applicable consumer protection law. For lost or damaged shipments, please contact us promptly so we can assist with a carrier claim or an appropriate resolution.
6.4 International Orders. For orders shipped outside Canada (where available), you are the importer of record and are responsible for any customs duties, import taxes, and brokerage fees imposed by the destination country.

Nothing in these Terms limits any rights or remedies you may have under applicable Canadian federal or provincial consumer protection legislation.
8.1 Account Registration. You may create an account to facilitate ordering. You agree to provide accurate and complete information and to keep it up to date.
8.2 Account Security. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account. We are not liable for losses arising from unauthorized use of your account caused by your failure to safeguard your credentials.
8.3 Termination. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the Site.
All content on the Site — including text, graphics, logos, product names, images, photographs, videos, page layouts, and software — is the property of Luminec or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws. “Luminec” and associated logos are trademarks of Luminec. You may not copy, reproduce, republish, distribute, modify, or create derivative works from any Site content without our prior written consent, except for personal, non-commercial viewing of the Site.
10.1 Submissions. If you submit reviews, comments, photos, or other content to the Site or tag us on social media (“User Content”), you grant Luminec a non-exclusive, royalty-free, perpetual, irrevocable, worldwide licence to use, reproduce, modify, publish, translate, and display such User Content in connection with our business, including marketing, without compensation to you.
10.2 Standards. You agree that your User Content will not be unlawful, defamatory, obscene, misleading, infringing of third-party rights, or contain malware or spam. We may, but are not obligated to, monitor, edit, or remove User Content at our discretion.
10.3 Authenticity. Reviews must reflect your genuine experience with our products. We reserve the right to remove reviews we reasonably believe to be fake, incentivized without disclosure, or otherwise misleading.
You agree not to use the Site: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any applicable laws or regulations; (d) to infringe our or any third party’s intellectual property or privacy rights; (e) to submit false or misleading information; (f) to upload or transmit viruses or malicious code; (g) to scrape, harvest, or collect data from the Site by automated means without our written consent; (h) to interfere with or circumvent the security features of the Site; or (i) to purchase products for unauthorized resale. We reserve the right to terminate your access to the Site for violating any prohibited use.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. Your use of third-party services is at your own risk and subject to their terms.
Your use of the Site is also governed by our [Privacy Policy], which describes how we collect, use, and disclose personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. By using the Site, you consent to such collection, use, and disclosure.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL PRODUCTS AND SERVICES OFFERED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SOME JURISDICTIONS, INCLUDING CERTAIN CANADIAN PROVINCES, DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS. NOTHING IN THESE TERMS EXCLUDES, RESTRICTS, OR MODIFIES ANY CONDITION, WARRANTY, GUARANTEE, RIGHT, OR REMEDY IMPLIED OR IMPOSED BY APPLICABLE CONSUMER PROTECTION LEGISLATION THAT CANNOT LAWFULLY BE EXCLUDED, RESTRICTED, OR MODIFIED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
(a) IN NO EVENT SHALL LUMINEC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED THROUGH IT, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND
(b) OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
THE FOREGOING LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING APPLICABLE PROVINCIAL CONSUMER PROTECTION LEGISLATION.
You agree to indemnify, defend, and hold harmless Luminec and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; or (c) your User Content.
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including without limitation natural disasters, epidemics, labour disputes, carrier delays, supply chain disruptions, power or internet outages, government actions, or acts of war or terrorism.
18.1 Governing Law. These Terms and any dispute arising out of or relating to them or your use of the Site shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
18.2 Jurisdiction. Subject to any mandatory consumer protection legislation granting you the right to bring proceedings in your province or territory of residence, you agree to submit to the non-exclusive jurisdiction of the courts of the Province of Ontario.
18.3 Informal Resolution. Before commencing any formal proceeding, you agree to first contact us at the email address below and attempt in good faith to resolve the dispute informally.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing to be effective.
These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies posted on the Site, constitute the entire agreement between you and Luminec regarding your use of the Site and supersede any prior agreements or understandings.
We may update or modify these Terms at any time by posting the revised version on this page with an updated “Last Updated” date. Changes take effect upon posting. Your continued use of the Site after any changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically. Material changes will not apply retroactively to orders already shipped.
